Appeal Court Dismisses Sen Melaye’s Suit, Affirms Smart Adeyemi’s Election

The Court of Appeal in Abuja has affirmed the judgement of the Kogi State National Assembly Election Petition Tribunal, which had on June 10, 2020 upheld the election of Smart Adeyemi as the senator representing Kogi West Senatorial District.

The judgement of the tribunal was on a petition by former Senator Dino Melaye challenging the declaration of Adeyemi as the winner of the Kogi West Senatorial rerun election.

Justice Kashim Kaigama, leading a 3-man panel had unanimously dismissed the petition by Melaye for lacking in merit.

But not satisfied with the tribunal’s verdict, Melaye headed to the appellate court to seek redress.

In a judgement, a 3-man panel of judges led by Justice Ibrahim Saulawa, of the Court of Appeal, dismissed Melaye’s appeal for lacking in merit.

Addressing newsmen shortly after the judgment was delivered, Counsel to Senator Adeyemi, Adekunle Oladapo said the judgment will redefine the electoral jurisprudence of Nigeria.
